Terms of Service
The words ‘we’, ‘us’, and ‘our’ refer to I-2000, Inc.; the words ‘you’ and ‘your’ refer to the customer whose signature appears below or who otherwise agrees to these Account Terms and Conditions, and all persons who the customer allows to use our services. This is a contract. It spells out terms and conditions of access to I-2000, Inc. systems and outlines your and our responsibilities. It also limits our liability. By using this service you agree to the terms and conditions contained herein. I-2000, Inc. services may be used only for lawful purposes. Transmission or solicitation for reception of material that violates US Federal or Michigan State Law, or State Law of the state from which you are transmitting or receiving is prohibited. Specifically, by using this service, you agree not to knowingly transmit or receive material that is threatening, legally obscene, libelous or violates trade-secret, patent or copyright protections while using I-2000, Inc. services. You agree to indemnify and hold harmless I-2000, Inc. and its owners and it's employees from all claims that are a result of your usage, without limitation. I-2000, Inc. makes no warranties or representations of any kind for the services that are being provided, including, but not limited to, the compatibility or interoperability of the services, or any portion of them, with your equipment, hardware, software, computer network, telephone system, or other data or voice communication system. You waive any and all claims and defenses that may arise from failure, inconsistency, and/or interruption of the services or any portion of them; your sole remedy for any of these events is cancellation of your subscription and refund of the unused portion of your subscription fee, if any.
We explicitly disclaim any warranty of merchant-ability or fitness for any purpose whatsoever, including, but not limited to, the suitability of the services as a ‘backbone’ or carrier of any particular type of data. We are not responsible for any loss you suffer as a result of using I-2000, Inc., including but not limited to loss resulting from delays, improper or incomplete delivery of information, possible "computer viruses" or interruption of service, regardless of cause. We do not guarantee the continued availability of any services offered on the Internet at the time of account creation. Notwithstanding the above, you agree that should we be found liable in a court of law for any action or lack of action related to your use of I-2000, Inc. our liability is limited to the unused portion of your subscription fee.
Electronic Communication Privacy Act of 1986-NOTICE: You agree that I-2000, Inc. facilities are not to be considered a secure communications medium for the purposes of the ECPA, and that no expectation of privacy is afforded. You agree that the security of your account, including the password, is your responsibility and that all use that emanates from your account will be considered to be undertaken by you unless it can be shown to have been an unauthorized intrusion. You agree to notify I-2000, Inc. immediately if you believe that your account has been or is being compromised. You agree not to obstruct the system's identification procedures in electronic communications that you initiate. Anonymous services may be used provided that you do not attempt to impersonate others. The transmission of unsolicited advertising through mass-electronic mail, or other direct transmission is prohibited. General commercial use of I-2000, Inc. is encouraged. You agree not to abuse the system and its resources. You agree not to attempt to violate the security of this system or its authentication and accounting procedures. You agree to notify us if you move or otherwise change your mailing address. You further agree to provide a regular postal address that is your primary legal residence or place of business. We will not disclose this information to any third party except upon the presentation to us of a facially valid warrant, subpoena, or court order, or as otherwise required by law. We reserve the right to use this information for internal I-2000, Inc. purposes and to advise you of new service and product offerings by I-2000, Inc. We do not sell our mailing list to other companies under any circumstances.
I-2000, Inc. will bill our Customers at the beginning of each billing cycle for service during that billing cycle. Payment is due upon the Customer's receipt of the bill. If payment is not received within 30 days of the billing date, the account may be terminated and the customer will be subject to a late fee of $2.50 per period and additional reconnection fees to reestablish the account if terminated. Termination does not remove the Customer's responsibility under this Agreement to pay all fees incurred up to the date of actual termination. Closed accounts with debit balances which remain unpaid for three months will incur an additional $10 late fee to facilitate the collection process. All reconnection fees are due prior to the commencement of service. Upon termination of a subscriber's account all data stored in the customer's directories will be deleted.
The Customer may terminate this service at any time upon thirty days prior written notice. The Customer is responsible to pay all fees up to the date of termination of the service, except where I-2000, Inc. is unable to provide services under this agreement through it's own negligence. Termination will be effective at the end of the month following the 30th day after I-2000 INC. receives notification. I-2000, Inc. reserves the right to change these terms and conditions at any time, as well as the services offered. Posting of the new terms and conditions, or service changes on the system, on our World Wide Web site shall constitute sufficient notice to you; and your use of our services shall constitute your consent to the changes. We will make reasonable efforts to mail a notice of any rate increase to you at least 30 days before the increase is to take effect, but our failure to mail such a notice, and/or any failure of delivery of such a notice to you, shall not relieve you of any obligation to us. Violation of any of the terms and conditions of service may result in the cancellation of your subscription and the forfeiture of the remainder of your subscription fee. Customers who are provided by I-2000 with equipment to connect to I-2000 services recognize that the equipment remains the property of I-2000 Inc. and they are solely responsible to return such equipment to an I-2000 business office within 90 days of the end of the service period. The equipment is expected to be returned in the same condition as the equipment was when provided to the customer, ordinary wear and tear excepted, or pay equivalent replacement value of $100 to $200 for DSL equipment and $550 for wireless radio/antenna equipment. The customer further accepts that the correct venue for any legal action by the company or against the company is with the court where I-2000 is domiciled.
If you are the guardian or parent of a minor who is requesting access, read these pages in their entirety. There are aspects of this service that are not under our complete control, and it is important that you understand and agree with these limitations in the classification of material. Some material on this system or available via this system may contain adult themes or subject matter. By using this service parents and/or guardians agree that I-2000 is not responsible for censoring or monitoring the system to prevent minors from receiving inappropriate material.
